Frequently Asked Questions

WHAT IS MEDIATION?
The main advantage of mediation is that it saves money. Another benefit is its flexibility. Many commercial disputes can be resolved without resorting to legal processes. In mediation, the parties are able to air their views and work together to seek resolution of their differences.

Mediation is a process of alternative dispute resolution in which a neutral third party, the mediator, assists two or more parties in order to help them negotiate an agreement, focusing on a matter of common interest, towards an agreement for the common interest of the parties.

HOW DOES FAMILY MEDIATION WORK?
You will be offered a series of meetings, initially after a free assessment session with one or two mediators. The assessment is the chance for you and the mediator to decide whether mediation is the right way forward for you and your situation. If mediation is suitable you will be offered a series of meetings. You will have a comfortable and informative setting; we will help you collect all the relevant information; we will help you discuss and explore possible arrangements to suit the parties involved.

HOW MUCH WILL FAMILY MEDIATION COST AND HOW LONG DOES IT TAKE?
We charge for mediation based on people's income and capability to pay, making it competitive and affordable. We charge per individual per session and our charges are in par with charitable organisations. You can ask about the cost of mediation, before confirming that you want a mediator to work with you.

How long it will take depends on the complexity of your circumstances, but mediation typically takes between 3-5 meetings.

WHAT IS COMMERCIAL MEDIATION?
Before the mediation, the parties will prepare from their point of view Position Statements and send them to the mediator. The mediation will begin with a joint introductory session. Other parties and legal representatives may be present, as may any other party with a legitimate interest in the dispute. Each party will then retire to their own rooms and the mediator will move between each room. The mediator will explore the issues with each side in private. The mediator might gather both parties together to work out a solution, or might move between them so that they do not have to meet. As the day progresses, the mediator will assist the parties to formulate pragmatic solutions.

HOW MUCH WILL COMMERCIAL MEDIATION COST & HOW LONG WILL IT TAKE?
At mediation services, we charge based on a one-day session per client to be agreed per case with clients. This will last from 10 am to 6 pm and will involve several hours of pre-reading. We also charge based on a half-day session per client. This will be a four-hour session. Some mediation continues after the four hours and there may be an additional hourly charge after if this happens. There may also be chargeable disbursements such as room-hire costs. The fees are shared equally between the parties.
